Chapter 18.04. SURFACE MINING AND RECLAMATION |
§ 18.04.160. Record keeping.
A.
Record Keeping. The county shall establish and maintain in-house measures and procedures to ensure organized record-keeping and monitoring of surface mining reclamation under its jurisdiction. The county shall forward a copy of each permit and approved reclamation plan to the Department of Conservation. (14 CCR Section 3504)
B.
Reclamation plans, reports, applications, and other documents submitted pursuant to this chapter are public records, unless it can be demonstrated to the satisfaction of the county that the release of that information, or part thereof, would reveal production, reserves, or rate of depletion entitled to protection as proprietary information. The county shall identify such proprietary information as a separate part of the application. Proprietary information shall be made available only to the Director of the Department of Conservation and to persons authorized in writing by the operator and by the owner. (PRC Section 2778(a))
C.
A copy of all reclamation plans, reports, applications, and other documents submitted pursuant to this chapter shall be furnished to the Director of the Department of Conservation by the county on request. (PRC Section 2778(b))
