§ 18.04.170. Abandoned mine reclamation.

    The county establishes a mine reclamation program for the purpose of administering funds received from the state under the Surface Mining Control and Reclamation Act of 1977, or through amendments to the federal general mining laws (30 United States Code Sections 1, 12A, 16, 161, and 162, and 602, et seq.). (PRC Section 2796(a))

    B.

    There is created by the county an abandoned mine reclamation fund. The money in the fund may be expended, upon appropriation by the state Legislature and grant to the county, as required by federal legislation amending the federal general mining laws, and for the following purposes prescribed in PRC Section 2796(b)(1) and (2).

    C.

    The expenditure of money from the abandoned mine reclamation fund shall reflect the priorities as specified in federal statute and in PRC Section 2796(d).
